Horizontal liberalisation of free movement of services in the European Union

The area of interest of the thesis is the horizontal liberalisation of the free movement of services based on Directives No. 2006/123/EC on services in the internal market, No. 2005/36/EC on the recognition of professional qualifications, No. 96/71/EC concerning the posting of workers in the framework of the provision of services and No. 2000/31/EC on electronic commerce. More precisely the main subject matter can be defined as the shift in the basic legal regime of free movement of services achieved through these four directives compared to the original state, i.e. the general regime under EU primary law as interpreted by the ECJ. The main objective is to analyze and critically assess the extent and significance of this shift. The basic questions are: To what extent is the resulting legal framework formed by the four horizontal directives different from the original situation? Is it merely a codification of the case law of the ECJ or a result of legislator's efforts to liberalise further the regime? To what extent does the liberalised regime enable or support abuse of free movement of services in order to circumvent the national law of the host state? This bachelor thesis focuses on analysis of legislation regulating free movement of services and Directive on services in the internal market. The thesis is divided into two parts. Theoretical part concentrates on defining the concept of ser-vices and its key features along with analysis of the crucial sections of the Directive 2006/123/EC. Thesis focuses especially on the cross-border service pro-vision and activities related to it. Practical part concerns the comparison of the implementation of the Directive into national legislation in Czech Republic, Slovakia and Poland. Moreover, it examines the effects of this regulation on local markets through the evolution of selected macroeconomic indicators.
Posting of workers in the framework of the European Union

This thesis deals with the institute of the temporary posting of workers in the framework of the provision of services between the member states of the European Union. It aims to describe in detail and to analyse the legal regulation of the issue and to highlight the uncertainties that occur during the realisation of the posting. The first part deals with the primary law of the European Union and with the related jurisprudence of the Court of Justice of the European Union, while emphasising the link to the internal market and the freedom to provide services. The second part deals with the detailed analysis of the Directive 96/71/EC of the European Parliament and of the Council of 16 December 1996 concerning the posting of workers in the framework of the provision of services which represents the basic regulation of the posting of workers at the European level. It is followed by the third part which deals with the later adopted Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 on the enforcement of Directive 96/71/EC concerning the posting of workers in the framework of the provision of services which seeks to prevent fraudulent practices and provide better information on the labour law conditions to be applied to posted workers. Temporary provision of services in the EU internal market

The bachelor thesis is focused on free movement of services within the EU and EEA Members states and Switzerland, as one of the freedoms of the EU single market. EU single market offers to service providers to expand their business to other Member states in the form of temporary provision of services through the posting workers by employers or cross-border provision of services by self-employed persons or freelancers. The thesis focus especially on requirements that service providers have to fulfil in case of temporary provision of services in all Member states, specifically it focus on requirements that are set in the Czech Republic. The final chapter presents possible barriers for service providers.

Subject of bachelor theses Activity analysis of Point of single contact is description of activities and services which Points of single contact provide to help entrepreneurs to business in the single internal market of the European Union. The theoretical part is focused on the development and importance of the EU, EU documents, which influenced the creation of single internal market, on European and Czech institutions that are responsible for monitoring, coordinating and ensuring processes associated with the formation of the internal market and especially the free movement of services. The practical part describes the implementation of the Service Directive in the EU internal market into the legal system of Czech Republic, the law on the free movement of services and especially analysis of the activities of PSCs. The conclusion is aimed on summarizing the results of the analysis.
Vnitřní trh EU: silniční kabotáž v kontextu východního rozšíření

Tato práce je zaměřena na specifika volného pohybu služeb na vnitřním trhu EU na konkrétním příkladu kabotáže. V souvislosti s tzv. východním rozšířením EU došlo k zavedení přechodného období na poskytování kabotáže pro země SVE. Cílem této práce je analýza příčin tohoto rozhodnutí EU na základě dostupných informací a také názoru odborníků z oblasti silniční dopravy ČR. Na závěr je konstatován převažující vliv faktorů politického charakteru nad oficiálními důvody - rozdíly ve výši provozních nákladů.
